Freedom of Information – Tasering a Woman in a Diabetic Coma; As Cowardly As It Gets and the Denial of Public Records – Redmond, WA (Part 20)

Credit: http://definitions.uslegal.com/f/fabricated-evidence/

Fabricated Evidence Law & Legal Definition

Fabricated Evidence is fictitious testimony or documents offered to a court or jury in order to mislead them. Fabricating evidence involves arranging or manufacturing circumstances or indica, after the act is committed with the intention to use them as evidence and make it appear accidental. Such evidence may be wholly forged and artificial, or it may consist in so warping and distorting real facts to create an impression in the minds of those who observe them as true and genuine.”

Now read the very bottom and YOU MAKE THE CALL.

I can’t imagine anything more COWARDLY than tasering a woman who’s only crime was being in a diabetic coma, but then again, that’s hardly a crime. But to break the law and deny public records because of such a COWARDLY act? Come on. Redmond, abide by the Public Records Act RCW 42.56 or pay up per document. The records act isn’t for you to cherry pick what records you want to provide and not provide. I don’t care how you search for records, that’s not my problem. I require all IDENTIFIABLE records per law. Must I go over what a public record is? You know, maybe if you weren’t conducting yourself in this fashion or breaking laws or going through such great lengths of official misconduct, or Class C Felonies, perhaps you could focus on what you are supposed to be doing, but it’s quite apparent you continue on in your ways. That’s not on me. That’s on the City of Redmond. Enjoy Part 20.

AND THE DENIAL OF PUBLIC RECORDS ACKNOWLEDGEMENT:

Brent, as I previously explained, you requested records relating to fabrication of evidence and the incident with the diabetic woman did involve fabrication of evidence.  If you would like to request records related to that incident, please make a new public records request to the City in the ordinary course.

Thank you.

I already requested all those public records in a formal public records request. There is no need to request it again. I have requested all identifiable records. Of course it involved fabrication of evidence. Women that get tasered or people in a diabetic coma don’t just get tased for being in a coma, nor for byproduct odors with windows rolled up and doors locked. Refer back to the original public records request.

While the City of Redmond tally’s up emails, or public records requests, let the record speak for itself why emails continue or public records have been requested, more so, why the City fails to provide identifiable records, let alone in a timely basis that affect lawful remedies.

Ms. Summerfield,
To date the City of Redmond and OMW has failed to provide all records as it pertains to fabrication of evidence, including the tasering of the woman in a diabetic coma. That includes any complaints, and all records in the original public records request. The fact that you can’t seem to search the information out is not my problem; as you are aware you are to provide all identifiable records.
I am still waiting and this has gone far beyond a reasonable amount of time. Provide the records as they pertain to the woman being tasered for no reason a diabetic coma and all other records and that includes complaints, as there was a complaint on this one, a big complaint at that.
If you have any further questions, please see the original public records request or the entire paper trail above that is well documented. But under no circumstances has the City of Redmond provided all the records per request, and nor is this records request closed.

Since I hope to have a large installment end of October then early or mid-October would be fine.
You can either send to my office or mail or drop off at City Hall. Thanks.

FOR SOME REASON I THINK THE CITY OF REDMOND WANTS ME TO FORGET ABOUT THE TASERING OF A WOMAN IN A DIABETIC COMA AND THE FABRICATION OF EVIDENCE AS THE ORIGINAL PUBLIC REQUEST SOUGHT, AMONGST OTHER RECORDS. I DIDN’T FORGET.

REDMOND….Best have all records as it relates to FABRICATION OF EVIDENCE (all records, not just cowardly acts of tasering a woman in a diabetic coma) in the installment in October, because I haven’t seen it yet, let alone that you are going to provide it. See here. You will provide the records per RCW 42.56 or pay up per document, per day, plus legal fees. This has gone on long enough. And I do look forward to your response from today.

Hello. As you know I am an attorney for the City of Redmond, assisting the City in responding to your public records request to the City received by email, dated December 18, 2014, at 9:30PM.

You requested: “all public records (including complaints) related to false claims, untruthfulness, or acts generally known to be “dishonest” pertaining to the City of Redmond. This will include public officials, officers, your prosecutor’s office, and City Attorney, including any law firms contracted by the City of Redmond. I am also seeking all public records pertaining to fabrication of evidence, suppression of evidence, and the withholding of public records as per request and by law.”

For efficiency in processing the City is breaking this request into two parts, as follows:

Dec #23A. all public records (including complaints) related to false claims, untruthfulness, or acts generally known to be “dishonest” pertaining to the City of Redmond. This will include public officials, officers, your prosecutor’s office, and City Attorney, including any law firms contracted by the City of Redmond

Dec #23B. all public records pertaining to fabrication of evidence, suppression of evidence, and the withholding of public records as per request and by law.

In accordance with RCW 42.56.520, I am writing to provide you with an estimate of the time anticipated to comply with your request. I understand from your email to Michelle Hart dated 12/22/14 at 3:0PM that you are requesting records back to the year 2000. I also understand that for Dec #23B you are seeking all complaints to the City containing allegations of fabrication of evidence, suppression of evidence and improper withholding of records.

Due to the number of pending records requests from you and others and workloads at the City, along with significant research to locate these records, the City estimates records responsive to your request will be available, in whole or in part, by the end of May, 2015.

The records will be provided in electronic format on CD which may be picked up at the police department, or mailed to you after payment of postage and other applicable costs and you providing the City with a mailing address. If the searches result in a limited number of records, it is possible the records may be sent via electronic mail.

Thank you for your patience as the City works toward completion of your requests.

Brent, the City does not have any records responsive to the second portion of your request below (labeled Dec #23B). As for the first portion of your request, to help staff locate the records you are requesting, when you state “pertaining to the City of Redmond,” do you mean pertaining to an allegation that the City of Redmond (or public official, officer, prosecutor, etc.) engaged in untruthful/dishonest conduct? Records are not maintained in a manner that allows staff to locate the records based on this description. Do you have examples you can provide to help staff locate the records?

Thank you in advance.

Dec #23B. all public records pertaining to fabrication of evidence, suppression of evidence, and the withholding of public records as per request and by law.

You came back and said….

Brent, the City does not have any records responsive to the second portion of your request below (labeled Dec #23B

Why are you withholding the public records (evidence) as it pertains to Marchella Fogg and Gail Marsh? The common theme coming from your law firm and the City of Redmond is that there are no responsive records. What happened to the records in these two incidents? Or even the claims by a Ms. Lambert as it pertains to the City of Redmond and the fabrication of evidence or lying? All of this is very relevant to 23B. You might want to reconsider this one.
And if the City of Redmond wants to suppress these 2 incidents and say there are no responsive records, then that makes one wonder what else is being suppressed. Even I submitted a complaint pertaining to fabrication of evidence, in a formal complaint. That’s 3 that you claim there is no responsive records. And you say there are no responsive records?
Does the City of Redmond even conduct basic record keeping or is this why the City of Redmond persists in saying over and over that there are no responsive records?
I demand all the public records I have requested and that which seems to be suppressed.

My request stands just as I stated it.
This is what you broke it down for your records, not mine.
Dec #23A. all public records (including complaints) related to false claims, untruthfulness, or acts generally known to be “dishonest” pertaining to the City of Redmond. This includes obviously any public officer. This also includes any employee or group of employees that work in an official capacity within the City of Redmond. And this also includes any contractor hired by the City of Redmond.
I asked for all public records as per my request as requested.

Thank you for identifying a potential record from Ms. Lambert. A search will be performed for that letter. (If the City received such letter, not knowing the timeframe for the letter, it is possible the letter may have be destroyed in accordance with retention schedules.)

As for the Gail Marsh and Marcella Fogg matters, I am confirming whether or not those involved allegations of fabrication of evidence or suppression of evidence.

The City of Redmond and OMW has already said that there are no responsive records regarding exculpatory evidence for incidents of your Brady Cops and that there are no responsive records for exculpatory evidence withheld for any cases beyond the City of Redmond’s jurisdiction. There are some “words” for that and legal defintions….it’s called suppression of evidence.
You might as well address that as well for the record. From 2002 to who knows til when, 2014? to date? The City of Redmond said there are no responsive records for exculpatory evidence in any court cases as it relates to your Brady Cops. It is the prosecutors duty to provide all exculpatory evidence and yet you have already said and claimed that there are no responsive records. You might as well include that in your responses.

The lawsuit seeks $1 million dollars in damages for excessive force and negligence.

In their report, officers say they could smell alcohol inside Fuchs’ car, though the doors were locked and the windows rolled up.

I have not to my knowledge received anything on this incident, but as it relates to fabrication of evidence (records), meaning the entire police report, I take it the city will be responding with all the records, as it relates to allegations of fabricated evidence, including “In their report, officers say they could smell alcohol inside Fuch’s car, though the doors were locked and windows rolled up”, only to tase her and claim she was drunk despite the fact she was in a medical emergency and diabetic coma.

Not with the windows rolled up and the doors locked.

I want any and all records as it relates to allegations of fabrication of evidence (which includes complaints).

You asked for an example. This is a clear as day example. And it led to a woman getting tasered for no reason. And I believe it cost the taxpayers a lot of money.

to mayor

Mayor,

You are a public official.

I have documented evidence that I have received false and erroneous records with public records requests. I have documented evidence of false statements.

My public records request is that I am seeking, as per Washington State’s Public Records Act, all public records (including complaints) related to false claims, untruthfulness, or acts generally known to be “dishonest” pertaining to the City of Redmond. This will include public officials, officers, your prosecutor’s office, and City Attorney, including any law firms contracted by the City of Redmond. I am also seeking all public records pertaining to fabrication of evidence, suppression of evidence, and the withholding of public records as per request and by law.

If you were to read the public records requests I have submitted, and the records and statements back from your City, you will see in in chronological sequence the evidence which has brought this public records request.

Because you are an official public official, I expect the formal response to not be passed on but to come from you.

I am seeking all records in electronic format or email.
———————————————————
Note: As of August 14th, still haven’t seen a thing. I have read there are no responsive records. But I am still waiting. I have read that a woman in a diabetic coma was tased because they thought she was drunk driving, and read that they smelled alcohol as the attorney states “The odor is the product of insulin seizure.
And again, I have asked for all public records as it pertains to fabrication of evidence and with but one example: Not with the windows rolled up and the doors locked.” The City of Redmond will not provide these records and as you can see the City of Redmond can’t even admit this was fabrication of evidence. They would just rather ignore, obfuscate, and say there are no responsive records. Women in diabetic comas getting tasered? Remember the city. The City of Redmond WA. Their legal defense with the windows and doors rolled up, is that the odor is the product of insulin seizure.
