I am now aware that 3C has not been responded to and all responsive records have not been provided, in fact, no records were provided. And you say it is complete, and I am having to send you an email (one I sent you today) that it appears you have confused the requests, so you have been notified.
The public records request for 3C is below. I need the records in a timely manner and by now I believe this has gone far beyond a reasonable amount of time only to have you confuse requests. That is seen in the emails.
I’ll give you time to respond to this email and acknowledge the mistake on your end in writing. If I do not see that in a timely basis, you can rest assured that this will not be a public records request but all these records will be subpoenaed.
I will be glad to have a judge go over each email and take a look at what is going on with the public records requests, and that includes what has been seen today.
I will not be going to a website for records I have requested. I asked for all public records. I expect them in a timely basis no later than August 31st. If this request is not completed by that date, I will have no other option than to seek remedy by law and you can expect it all to be subpoenaed. And I do mean all of it.

Let me break this down.

Brent, this was a clarification to Dec #3, which you withdrew 12/22/2014 as a duplicate.
No that is false. The City of Redmond already pulled this stunt and I already told you multiple times that I didn’t withdraw the requests. The requests are alpha numeric. They all stand. I have told you that repeatedly. There never was any duplicate. Redmond closed the requests not me. Your delay is the problem here.

As a result the request was closed.

Your referral to the WSP website is hardly responsive to my public records request. But I will wait for your final answer and seek your confirmation that you made a mistake in all of this. I asked for all public records and you provide a website.

I expect all responsive records with this public records request by August 31st, 2015. I will no longer tolerate the City of Redmond’s obfuscation and total lack of regard for the law.

So I am looking forward to your admission that you screwed up today and I look forward to all the records in this request by August 31st, 2015 and that means 3C that was never (ever) cancelled, not however you are parsing things.

That is incorrect. I believe you are confusing 2 different requests here. That is why I have the requests in an alpha numeric sequence.
First, I submitted a public records request from the City of Redmond for all records, not to go to some website. Secondly, that is not even the request I am asking about. The request pertained to the breathalyzer equipment, you just provided a download about the breathalyzer readings.
I am aware of 2 different occasions that the breathalyzers were not even legally certified, thus the request. This request is not complete.
So I take it that this request is incomplete and I am still awaiting a timely response, but that is not happening from 12/15/14 til now.
You provided stickers once upon a time. That is not responsive to the public records request. I would strongly suggest going back and reading the public records request again and please get back to me in a timely basis. I believe you will see there is some confusion on your end.

Please advise.

I am in receipt of your email and the records that ARE NOT RESPONSIVE to my request. Not only that, but you again have confused 2 separate public records requests. My requests were clearly defined and were in alpha numeric order. So I will not even be getting into how you screwed up or how you parsed it all via the “clarification” tactic.
The WSP report is not responsive to my request. I have asked for all DUI’s specifically UNDER .08 (meaning .079 and under). That is not seen, and I asked for the records from the City of Redmond, not the WSP.
The City of Redmond has not fulfilled this request.
Also, the other request had to do with breathalyzers not being in compliance (that is clearly a separate request). It’s all clear as day in the alpha numeric requests I have submitted, there should be no confusion at this point.
REFER to my original requests since you seem to be confused. Besides it’s all chronological in sequence in emails and public record.
I do realize that you tried to send me stickers originally, which was telling in and of itself, but that was hardly responsive to a previous request that was cancelled. That is in the public record as well.
But I can see the City of Redmond pulls these stunts every step along the way.
This request is not from the City of Redmond. This request is not fulfilled. And you already gave me your final answer.
You can expect to hear back after August 31st. My requests were specific. That’s my final answer.

I don’t know what your email means. If there are no records at the City, there are no records at the City. I am sorry you do not like that answer. It doesn’t change the fact that we are not the record-owner… “identifiable” doesn’t have anything to do with that. You identified the records… the City searched… we do not keep those records… they are in the possession of the WSP… that’s all there is to it. This has been conveyed to you repeatedly. You will need to seek any records, if they exist, from the WSP.

Hello. As you know I am an attorney for the City of Redmond, assisting the City in responding to your public records request to the City received by email, dated December 18, 2014, at 9:30PM.

For efficiency in processing the City is breaking this request into two parts, as follows:

Dec #23A. all public records (including complaints) related to false claims, untruthfulness, or acts generally known to be “dishonest” pertaining to the City of Redmond. This will include public officials, officers, your prosecutor’s office, and City Attorney, including any law firms contracted by the City of Redmond

Dec #23B. all public records pertaining to fabrication of evidence, suppression of evidence, and the withholding of public records as per request and by law.

In accordance with RCW 42.56.520, I am writing to provide you with an estimate of the time anticipated to comply with your request. I understand from your email to Michelle Hart dated 12/22/14 at 3:0PM that you are requesting records back to the year 2000. I also understand that for Dec #23B you are seeking all complaints to the City containing allegations of fabrication of evidence, suppression of evidence and improper withholding of records.

Due to the number of pending records requests from you and others and workloads at the City, along with significant research to locate these records, the City estimates records responsive to your request will be available, in whole or in part, by the end of May, 2015.

The records will be provided in electronic format on CD which may be picked up at the police department, or mailed to you after payment of postage and other applicable costs and you providing the City with a mailing address. If the searches result in a limited number of records, it is possible the records may be sent via electronic mail.

Why are you withholding the public records (evidence) as it pertains to Marchella Fogg and Gail Marsh? The common theme coming from your law firm and the City of Redmond is that there are no responsive records. What happened to the records in these two incidents? Or even the claims by a Ms. Lambert as it pertains to the City of Redmond and the fabrication of evidence or lying? All of this is very relevant to 23B. You might want to reconsider this one.
And if the City of Redmond wants to suppress these 2 incidents and say there are no responsive records, then that makes one wonder what else is being suppressed. Even I submitted a complaint pertaining to fabrication of evidence, in a formal complaint. That’s 3 that you claim there is no responsive records. And you say there are no responsive records?
Does the City of Redmond even conduct basic record keeping or is this why the City of Redmond persists in saying over and over that there are no responsive records?
I demand all the public records I have requested and that which seems to be suppressed.

This includes obviously any public officer. This also includes any employee or group of employees that work in an official capacity within the City of Redmond. And this also includes any contractor hired by the City of Redmond.

The City of Redmond and OMW has already said that there are no responsive records regarding exculpatory evidence for incidents of your Brady Cops and that there are no responsive records for exculpatory evidence withheld for any cases beyond the City of Redmond’s jurisdiction. There are some “words” for that and legal defintions….it’s called suppression of evidence.
You might as well address that as well for the record. From 2002 to who knows til when, 2014? to date? The City of Redmond said there are no responsive records for exculpatory evidence in any court cases as it relates to your Brady Cops. It is the prosecutors duty to provide all exculpatory evidence and yet you have already said and claimed that there are no responsive records. You might as well include that in your responses.

In their report, officers say they could smell alcohol inside Fuchs’ car, though the doors were locked and the windows rolled up.

I have not to my knowledge received anything on this incident, but as it relates to fabrication of evidence (records), meaning the entire police report, I take it the city will be responding with all the records, as it relates to allegations of fabricated evidence, including “In their report, officers say they could smell alcohol inside Fuch’s car, though the doors were locked and windows rolled up”, only to tase her and claim she was drunk despite the fact she was in a medical emergency and diabetic coma.

As for the first portion of your request, to help staff locate the records you are requesting, when you state “pertaining to the City of Redmond,” do you mean pertaining to an allegation that the City of Redmond (or public official, officer, prosecutor, etc.) engaged in untruthful/dishonest conduct? Records are not maintained in a manner that allows staff to locate the records based on this description. Do you have examples you can provide to help staff locate the records?

I want any and all records as it relates to allegations of fabrication of evidence (which includes complaints).

You asked for an example. This is a clear as day example. And it led to a woman getting tasered for no reason. And I believe it cost the taxpayers a lot of money.

Mayor,

You are a public official.

I have documented evidence that I have received false and erroneous records with public records requests. I have documented evidence of false statements.

My public records request is that I am seeking, as per Washington State’s Public Records Act, all public records (including complaints) related to false claims, untruthfulness, or acts generally known to be “dishonest” pertaining to the City of Redmond. This will include public officials, officers, your prosecutor’s office, and City Attorney, including any law firms contracted by the City of Redmond. I am also seeking all public records pertaining to fabrication of evidence, suppression of evidence, and the withholding of public records as per request and by law.

If you were to read the public records requests I have submitted, and the records and statements back from your City, you will see in in chronological sequence the evidence which has brought this public records request.

Because you are an official public official, I expect the formal response to not be passed on but to come from you.
I am seeking all records in electronic format or email.

Note: As of August 14th, still haven’t seen a thing. I have read there are no responsive records. But I am still waiting. I have read that a woman in a diabetic coma was tased because they thought she was drunk driving, and read that they smelled alcohol as the attorney states “The odor is the product of insulin seizure.
And again, I have asked for all public records as it pertains to fabrication of evidence and with but one example: Not with the windows rolled up and the doors locked.” The City of Redmond will not provide these records and as you can see the City of Redmond can’t even admit this was fabrication of evidence. They would just rather ignore, obfuscate, and say there are no responsive records. Women in diabetic comas getting tasered? Remember the city. The City of Redmond WA. Their legal defense with the windows and doors rolled up, is that the odor is the product of insulin seizure.
